Terms of Service & User Agreement

These terms govern your use of the FlagOff.my registration and payment-verification portal for guest Wi-Fi Internet access operated by hotspot providers. Please read them before placing an order.

1. Our role: registration and assistance only

FlagOff.my is an intermediary platform. We provide the captive portal, order registration, payment-proof verification workflow and Access Code delivery assistance on behalf of the hotspot provider.

We are not the Internet service provider, telecommunications operator, network owner or seller of the Internet access package. The Internet service is supplied solely by the hotspot provider (the hotspot operator).

We do not hold, receive, control or process customer money. All customer payments are made directly to the hotspot provider through the provider's own DuitNow QR, bank account or cash counter. Any complaint, claim, refund or dispute about the service itself must be directed to the hotspot provider.

2. Acceptance of these terms

By opening the portal, creating an order, paying, uploading a payment proof, entering an Access Code or using the Wi-Fi service, you confirm that you have read, understood and accepted these terms and all related policies published on this portal.

You confirm that you are at least eighteen (18) years old and legally capable of entering into a contract under the Contracts Act 1950 and the Age of Majority Act 1971.

If you do not agree with any part of these terms, please do not use the portal or purchase Internet access.

3. Orders, payments and verification

DuitNow QR and bank transfer are manual payment methods. Internet access is not activated merely because a payment screenshot is uploaded. The hotspot provider's administrator verifies each payment before an 8-digit Access Code is issued.

You are responsible for the accuracy of the mobile number, package selection and payment reference you provide. Pay the exact order amount shown and keep your payment receipt.

Access Codes are issued for one device only (1 Code = 1 Device). Unless a package states otherwise, package validity starts from the first successful activation on the guest Wi-Fi, not from the date of purchase.

Orders that are not paid, cannot be verified or breach these terms may be rejected, cancelled or suspended without affecting any statutory rights you may have.

4. Hotspot provider responsibilities

The hotspot provider is solely responsible for the Internet service, including coverage, speed, quality, availability, uptime, equipment, installation, technical support, content and any interruption or failure of the service.

The hotspot provider is also responsible for its own licences and permits, including any requirement under the Communications and Multimedia Act 1998 and any local authority requirement.

The hotspot provider is the merchant of record for the transaction and is responsible for refunds, chargebacks and consumer remedies relating to the service it supplies.

5. Acceptable use

You agree not to use the Wi-Fi service or the portal for any unlawful purpose, including offences under the Communications and Multimedia Act 1998 and the Computer Crimes Act 1997, to access illegal content, to harass or harm others, to send spam, or to attempt unauthorised access to any network or system.

Access Codes must not be resold, shared, cloned or used on multiple devices. You must not attempt to bypass, abuse or interfere with the captive portal, router automation or verification workflow.

We may suspend or refuse registration assistance, and the hotspot provider may suspend service, for any breach of this section or where required by law or by a competent authority.

6. Disclaimer and limitation of liability

The portal and our registration and verification assistance are provided on an "as is" and "as available" basis. We do not promise that the portal, router automation or verification workflow will be uninterrupted, timely, secure or error-free.

To the fullest extent permitted by Malaysian law, FlagOff.my is not liable for any loss, damage, cost or expense arising from or connected to: the Internet service or its failure; the acts, omissions, delays or default of the hotspot provider; network or equipment faults; service interruptions; data loss; or any indirect, incidental, special or consequential loss.

We do not hold customer money and we do not receive any payment from customers, so our liability to any customer in relation to a transaction is excluded to the maximum extent permitted by law.

Nothing in these terms excludes, restricts or modifies any right or remedy you may have under the Consumer Protection Act 1999 or any other Malaysian law that cannot lawfully be excluded.

7. Indemnity

You agree to indemnify and hold FlagOff.my, its operator and staff harmless from any claim, loss, liability, cost or expense arising from your breach of these terms, your misuse of the portal or Wi-Fi service, or your violation of any law or third-party right.

8. Electronic communications and records

You agree to receive order updates, verification outcomes and Access Code delivery electronically through the portal, SMS or WhatsApp, consistent with the Electronic Commerce Act 2006.

Electronic records created by the portal (orders, payment proofs, audit events, activation records) may be relied upon as evidence of the transaction.

9. Changes, governing law and jurisdiction

We may update these terms and related policies from time to time. The version published on the portal at the time of your order applies to that order.

These terms are governed by the laws of Malaysia. Subject to any right you may have to bring a claim before the Tribunal for Consumer Claims Malaysia (TTPM), the courts of Malaysia have exclusive jurisdiction.

Complaints about the Internet service must first be raised with the hotspot provider. We may assist in coordinating communication but we do not decide service complaints, refunds or compensation.
