This summary describes the responsibilities of a hotspot provider using the FlagOff.my registration and verification platform. The full provider agreement is accepted by the provider when its account is created and when it publishes packages.
The provider owns and operates the Internet service, sets its own prices, packages, limits and service terms, and is the merchant of record for every customer transaction.
The provider receives all customer payments directly and is responsible for refunds, chargebacks, compensation and customer service for the Internet access it supplies.
The provider must hold all licences, permits and approvals required to operate its network and sell Internet access, including any requirement under the Communications and Multimedia Act 1998 and local authority rules.
The provider must not use the platform to supply unlawful services, unlawful content or services it is not licensed to provide.
The provider must verify manual payments promptly and in good faith, deliver the Access Code for every verified order, and never withhold service or refunds without lawful reason.
The provider must keep package, router, location and payment details accurate, and must inform customers of any material limitation of the service.
All customer payments go directly to the provider. FlagOff.my never receives, holds or controls customer money.
Any platform service fee is a separate commercial arrangement between the provider and the platform and is not charged to customers through the portal unless clearly disclosed by the provider.
The provider may use customer data received through the platform only to verify payments, deliver and support the service, and meet legal obligations, in accordance with the Personal Data Protection Act 2010.
The provider must keep customer data secure, must not use it for unauthorised marketing, and must not disclose it except as required for the service or by law.
FlagOff.my provides registration, verification workflow, Access Code delivery assistance and technical tooling only. It does not provide the Internet service and makes no warranty about service quality or availability.
The provider must not misrepresent itself as FlagOff.my, and must not state or imply that FlagOff.my is the Internet provider, the seller or the holder of customer funds.
The provider is solely liable for the Internet service, its customers, its staff and its compliance with law, and must indemnify FlagOff.my against any claim, loss, penalty or expense arising from the provider's service, conduct or breach of this agreement.
To the fullest extent permitted by Malaysian law, FlagOff.my is not liable for the provider's acts, omissions, service failures, refunds or disputes with customers.
FlagOff.my may suspend or terminate a provider account for breach of this agreement, unlawful activity, fraud, or risk to customers or the platform.
This agreement is governed by the laws of Malaysia, and the courts of Malaysia have exclusive jurisdiction.
